Legal Basis for Processing Your Personal Data
Our processing of personal data is based on the applicable legal framework, specifically the Swiss Federal Act on Data Protection (FADP) for users in Switzerland and the General Data Protection Regulation (GDPR) for users in the European Union.
This Privacy Policy applies accordingly:

We process personal data in accordance with Art. 4 (or Art. 6 of the revised FADP), ensuring transparency, lawfulness, proportionality, and purpose limitation. Processing is justified if it is necessary for the performance of a contract, based on your consent, or due to our legitimate interests. - For EU users (GDPR):
The legal basis for processing personal data is determined by Art. 6 GDPR, specifically:

Overview of How We Process Your Personal Data
Lesmeister Communications & Consulting, (hereinafter referred to as “Lesmeister Communications & Consulting” or “we”) only collects and uses personal data of the users of this website (hereinafter “you”) insofar as this is necessary for the provision of a functional website as well as for the provision of the relevant content and services of Lesmeister Communications & Consulting.
Data we process about you may include: Your IP-address, indications on the devices you use (if available) and/or name and contact details (for example name, address, phone number or email address) if you contact us via contact request form or per e-mail or comment our blog articles.
We use your personal data:
- to provide and improve our websites, including monitoring and evaluating its use;
- to promote our services, including by sending alerts, updates, event invitations and/or marketing messages to you;
- to comply with our legal, regulatory and risk management obligations, including establishing, exercising or defending legal claims.
How and With Whom We Share Your Personal Data
We may share your personal data with trusted third parties. For the purposes set out and where necessary, we may share personal data with courts, regulatory authorities, government agencies and law enforcement agencies. While it is unlikely, we may be required to disclose your information to comply with legal or regulatory requirements. We will use reasonable endeavors to notify you before we do this, unless we are legally restricted from doing so.
We may transfer your personal data to recipients abroad, including in countries that do not provide the same level of protection as your jurisdiction. We may also transfer personal data with your explicit consent and in certain other situations as permitted by applicable law. Your personal data is resp. may be stored in the following territories: Switzerland, European Union, or other countries.
Where we transfer personal data to countries outside Switzerland or the EU/EEA, we ensure appropriate safeguards such as Standard Contractual Clauses or adequacy decisions in accordance with applicable law.
Protecting Your Personal Data
We use various technical and organizational measures to help protect your personal data from unauthorized access, use, disclosure, alteration or destruction.
Data Retention and Deletion
The personal data of the data subject will be erased or blocked as soon as the purpose of storage ceases to exist, subject to statutory retention periods under applicable law. Furthermore, data may be stored if provided under Swiss law to which the controller is subject. The data will also be erased or deleted if a statutory retention period prescribed expires, unless there is a further need for the continued storage of the data (e.g. for the conclusion or fulfilment of a new contract or other statutory obligations under Swiss Law).
Website Functionality and Log File Usage
Every time you visit our website, our system automatically collects data and information from the computer system you are using. The following data is collected:
- The IP address of the user;
- The date and time of access;
- Information about the type of browser and the version used;
- The operating system of the user;
- Websites from which the user’s system accesses our website;
The data is also stored in the log files of our system. This data is not stored together with other personal data of the user. The legal basis for the temporary storage of the data and the log files is Art. 45c of the Swiss Federal Act on Telecommunications, Art. 4 and Art. 12 FADP (Art. 6 and Art. 30 of the revised FADP, entry into force September 2023) and, if and to the extent applicable, Art. 6 para. 1 lit. f GDPR.
The temporary storage of the IP address by the system is necessary in order to enable the website to be delivered to the user’s computer. For this reason the IP address of the user must remain stored for the duration of the session.
The data is stored in log files in order to ensure the functionality of the website. In addition, the data help us to optimize the website and to ensure the security of our information technology systems.
The collection of data for the provision of the website and the storage of data in log files is absolutely essential for operation of the website. The user consequently has no right to object.
Use of Cookies
Our website uses cookies. Cookies are text files that are stored in the web browser, or by the web browser on the user’s computer system. When a user visits a website, a cookie may be stored on the user’s operating system. This cookie contains a distinct character string that enables the unique identification of the browser the next time the user visits the website.
We use cookies in order to make our website functional. Some elements of our web page need Cookies in order to identify the browser again after the user has visited another page. For example the language settings are stored and transmitted in cookies.
We also use cookies on our website that enable an analysis of the user’s browsing behavior. By the use of these cookies, the following data is usually transmitted to us: (1) Search terms entered, (2) Frequency of page views, (3) Use of website functions.
Technically necessary cookies are used in order to make it easier for the user to browse the website. Some of the functions of our web pages may not be available unless cookies are used. For these functions it is essential that the browser is detected again after the user has visited another page.
Cookies are stored on the user’s computer and transmitted by it to our website. As a user, therefore, you have full control over the use of cookies. You can disable or restrict the transmission of cookies by providing for the corresponding settings in your web browser. Cookies already stored can be deleted at any time. This may also be done automatically. If cookies for our website are disabled, it may no longer be possible to make full use of all functions of the website.
The transmission of flash cookies cannot be disabled by settings on the browser, but may be disabled by changes to the Flash Player settings.
Contact via Forms and Emails
Our website provides for contact forms that can be used to make contact electronically with us. If a user makes use of this option, the data entered in the input screen will be transmitted to us and stored.
The following data will also be saved at the time the message is sent:
- IP address of the user;
- The date and time of registration;
- Information about the type of browser and the version used;
- The operating system of the user;
- The input at Google reCAPTCHA;
Alternatively, you can make contact using the email addresses provided by us, namely: (consulting@lesmeister.ch).
In this case the user’s personal data provided with the email will be stored in our systems.
Data provided in this context will not be forwarded to third parties but will only be used for the purposes of processing the conversation.
The legal basis for the processing of the data is Art. 4 FADP (Art. 6 of the revised FADP, entry into force September 2023) and/or Art. 12 FADP (Art. 30 of the revised FADP, entry into force September 2023) and, if and to the extent applicable, 6 para. 1 lit. a GDPR, if the user has given his consent. The legal basis for the processing of data transmitted in the course of sending an e-mail is Art. 6 para. 1 lit. f GDPR. If the e-mail contact aims at the conclusion of a contract, the additional legal basis for the processing is Art. 6 para. 1 lit. b GDPR.
We process the personal data provided by you in the input screen solely in order to handle the contact request. In the case of contact by email, this also establishes the necessary legitimate interest for us in processing the data. The other personal data processed during the send process is used to prevent any misuse of the contact form and ensure the security of our information technology systems.
The data will be erased as soon as they are no longer required in order to achieve the purpose for which it was collected. For the personal data from the input screen of the contact form and the personal data that was sent by email, this is the case when the respective conversation with the user has ended. The conversation has ended if the circumstances suggest that the relevant matters have been finally clarified.
The user has the possibility at any time to withdraw its consent to the processing of its personal data. If the user makes contact with us by email, he may at any time object to the storage of its personal data. In such a case the conversation cannot be continued.
The notice of objection must be sent to consulting@lesmeister.ch. In this case personal data stored in the course of contacting us will be erased.
Web-tracking Services
We are constantly aiming to improve our website. For this purpose, we collect anonymized data such as domain names, visited pages, and time spent on each page. We use Google Analytics (GA4), where user IP addresses are anonymized by default. The data collected is generally transmitted to and stored on servers in the United States. Data transfers to Google are based on the European Commission’s standard contractual clauses. For more information, see Google’s Privacy Policy.
We use Google Tag Manager to manage website tags efficiently. Google Tag Manager itself does not access or store personal data; it merely forwards behavioral data to connected analytics tools. For more information, please refer to the Google Tag Manager Use Policy.
Location data is integrated via Google Maps, where your IP address may be transmitted to Google’s servers in the USA. We have no control over this data transfer.
To protect our site from spam and fraud, we use Google reCAPTCHA, which determines whether a user is human via small challenges such as image selection.
All data is used exclusively for statistical and marketing purposes and is not shared with third parties. It will be deleted once it is no longer required for the stated purposes or stored only in anonymized form.
The collection of data for the enhancement of the website and its use for statistical and marketing purposes is essential for the operation of the website. Furthermore, the data is passed along to Google Analytics. If and to the extent that Google is using such data for own analytics purposes (as a controller), please refer to Google’s support information on Google Analytics and Google’s privacy policy. The cookies are stored on your computer, and you can delete them completely. You can prevent cookies from being stored or disable or restrict the transfer by adjusting the settings in your browser. You can deactivate Google Analytics by downloading and installing the Google browser add-on. You can download the Google Analytics browser add-on here.
If you are logged into a user account of a provider, you would enable this provider to assign your surfing behavior directly to your personal profile. If you do not want these providers to be able to assign the visit to our pages to your user account, please log out of your respective user account before using our website.
Rights of the Data Subject
If your personal data is processed, you are a data subject within the meaning of the Swiss Federal Act on Data Protection (FADP) and/or the General Data Protection Regulation (GDPR), and you have the following rights vis-à-vis the controller:
- Right of access to your data stored by us and information on its processing (Art. 8 FADP, Art. 25 revised FADP, Art. 15 GDPR);
- Right of access in particular regarding the existence of automated individual decision-making, including profiling (Art. 14 FADP, Art. 19 revised FADP, Art. 22(1) and (4) GDPR);

The FDPIC does not have direct judicial or enforcement powers, but may review and assess data processing activities, issue recommendations, and/or seek enforcement through judicial proceedings.
If you are resident in an EU Member State, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or place of the alleged infringement (List of EU Supervisory Authorities). The authority will inform you about the progress and outcome of your complaint, including the possibility of a judicial remedy pursuant to Art. 78 GDPR.
